This Passenger Charter Contract (“Contract”) is a legally binding agreement between World Pride Cruises LLC (hereinafter “World Pride Cruises,” “WPC,” “we,” “us,” or “our”) and each individual or entity that books or travels on a WPC Trip (“Guest,” “you,” or “your”).
By booking a trip, placing a deposit, paying any fare, receiving a ticket/boarding pass, or otherwise indicating acceptance (e.g., clicking “I Accept”), you acknowledge that you have read, understood, and agree to be bound by this Contract on your own behalf and on behalf of every person on your reservation.
Entire Agreement; No Oral Modifications
This Contract, including any incorporated Supplier Ticket(s), addenda, or policy references, constitutes the entire understanding between you and WPC.
No employee or agent of WPC can modify these terms orally. Any changes must be in a written document signed by an authorized WPC representative.
Key Points
This Contract includes liability limitations, mandatory arbitration, non-refundability clauses, comprehensive conduct guidelines, accessibility provisions, and itinerary change disclaimers.
If you do not agree with these Terms, we respectfully ask that you refrain from booking, paying for, or participating in any World Pride Cruises trip.
2. DEFINITIONS
“Trip,” “Cruise,” or “Charter”: Any vacation, cruise, tour, event, resort stay, or service sold, organized, or provided by WPC, including transportation, accommodations, and excursions.
“Supplier”: Any cruise line, hotel, airline, resort, transportation company, tour operator, or other vendor providing services for your Trip.
“Guest,” “Passenger,” “You”: Any person booking, paying for, or traveling on a WPC Trip.
“Contract”: This agreement, plus any referenced or incorporated addenda, Supplier Tickets, and disclaimers.
3. RELATIONSHIP WITH SUPPLIERS
Independent Contractors
WPC is a charterer, group organizer, or intermediary, not the owner or direct operator of vessels, airlines, or resorts. Suppliers are independent contractors, not WPC’s employees or agents.
Supplier Tickets & Policies
Your booking also requires compliance with each Supplier’s own passenger ticket contract, terms, or policies (“Supplier Ticket”). In the event of a conflict solely concerning the Supplier’s liability, the Supplier Ticket will take precedence.
No WPC Liability for Supplier Acts
WPC is not responsible for any injury, loss, damage, or claim arising from any act, omission, or negligence of a Supplier or any other third party not under our direct control.
4. NATURE OF THE CRUISE & ENTERTAINMENT
Special or Themed Events
Some WPC Trips may feature live performances, celebrity appearances, themed activities, or multi-artist lineups. The fare you pay does not guarantee access to all events or meet-and-greets. Scheduling and availability may vary.
Artist Cancellation or Substitution
If an announced performer or activity is canceled or changed, WPC may substitute a comparable act or adjust the entertainment schedule. Your remedy is limited to what is expressly offered (e.g., a replacement show). No further liability for WPC or the Supplier.
No Guaranteed Artist Interaction
WPC does not guarantee you will meet or obtain autographs/photos with any performer or celebrity. Appearances may be limited by scheduling, capacity, or other operational factors.
5. HEALTH & SAFETY PROTOCOLS
Health Screenings & Entry Requirements
You may be required to complete health questionnaires, show proof of vaccination, undergo temperature checks, or provide negative test results (COVID-19 or otherwise) if required by Suppliers or authorities.
Non-compliance or failure to meet these requirements may result in denied boarding without refund.
Onboard Safety & Sanitation
WPC or the Supplier may enforce masking, distancing, or other public health measures. You agree to abide by all safety instructions to protect yourself, fellow travelers, and crew.
Symptom Reporting & Quarantine
If you exhibit symptoms of a contagious illness, you may be required to isolate in your stateroom or a designated area. WPC and Suppliers have no liability for missed experiences or financial losses due to quarantine.
Medical Care & Costs
You are responsible for any medical expenses, including treatment, evacuation, or hospitalization. WPC disclaims liability for the availability, quality, or outcomes of onboard or remote medical services.
Confidentiality of Medical Information
Any medical or health information you share with WPC is treated confidentially and used only as necessary to arrange accommodations or comply with legal/health obligations.
6. ELIGIBILITY, AGE RESTRICTIONS & FAMILY TRAVEL
Legal Capacity & Age
You must have the legal capacity to enter this Contract. Passengers must be at least 18 years old at the time of departure to attend.
Some Suppliers require guests to be 21+ to sail or disembark in certain ports. You must comply with whichever standard is more restrictive.
7. ACCESSIBILITY & SPECIAL-NEEDS ACCOMMODATIONS
Commitment to Inclusivity
WPC is committed to providing an inclusive environment for all guests, including those with disabilities or special needs, in accordance with the Americans with Disabilities Act (ADA) (where applicable) and other relevant laws.
Advance Notice & Requests
If you require special accommodations, accessible staterooms, sign language interpretation, or mobility/medical assistance, inform WPC at booking or at least 60 days prior to departure.
While WPC will make good faith efforts to facilitate, certain accommodations may be limited by the vessel’s design, ports’ infrastructure, or Supplier constraints.
Service Animals & Mobility Aids
Service animals trained to perform specific tasks for a person with a disability are generally permitted. Emotional-support animals typically do not qualify. You must notify WPC in writing and provide any required documentation.
Guests using wheelchairs/scooters must bring or arrange their own equipment. WPC can provide referrals to rental services if available.
Onboard & Onshore Accessibility
Not all areas of the ship or resort may meet U.S. ADA standards, especially in international ports. Excursions may have limited accessibility. WPC is not liable if local facilities cannot accommodate your needs.
Medical & Dietary Needs
Inform WPC of any dietary restrictions (e.g., gluten-free, allergies) or medical devices (e.g., CPAP) as early as possible. You may need to bring extension cords, adapters, or backup batteries.
8. PRICING & PAYMENTS
Advertised Fares
Fares are in U.S. dollars, typically based on double occupancy, excluding taxes, port fees, surcharges (fuel, currency fluctuations), optional excursions, specialty dining, or insurance, unless otherwise stated.
Deposit & Final Payment
A non-refundable deposit is due at booking; subsequent installments or final payment dates will be stated in your confirmation. Failure to pay timely may result in cancellation and forfeiture of amounts paid.
All Payments Non-Refundable
Unless explicitly stated otherwise in writing, all deposits and payments are non-refundable. WPC strongly recommends that you obtain travel insurance for protection.
Payment Methods & Late Fees
We accept most major credit cards and debit cards. Late or declined payments may incur fees (e.g., $150) and risk cancellation of the reservation.
Additional Charges
WPC may collect taxes, surcharges, or mandatory fees in advance or add them to your onboard/resort account. You are responsible for settling your account before disembarkation/departure.
9. CHANGES, TRANSFERS & CANCELLATIONS
Reservation Changes
The Lead Passenger must request changes (e.g., name swaps, adding/removing guests, cabin upgrades). Administrative fees (e.g., $150) may apply.
Downgrading (moving to a lower fare category) is generally not permitted once booked.
Transfers of Reservation
With WPC’s written consent, you may transfer your booking to another person for a fee (e.g., $150). Transfers are typically disallowed if the event is sold out or a waitlist is active.
Cancellation by Guest
All amounts paid are non-refundable upon your cancellation, unless your booking confirmation explicitly states otherwise.
No Show / Early Departure: If you fail to appear on embarkation day or leave early, you forfeit all monies paid—no refunds or credits will be issued.
Cancellation or Change by WPC/Supplier
We or the Supplier may cancel, postpone, or alter a Trip at any time for reasons including insufficient bookings, Force Majeure, or operational needs. If canceled before departure, you may receive a refund or credit (our sole liability). If canceled mid-trip, a pro rata credit/refund may apply.
No Refund for Unused Services
No refund, credit, or compensation is provided for any unused service or portion of the Trip (e.g., if you skip a scheduled excursion or dine elsewhere).
10. TRAVEL DOCUMENTS & COMPLIANCE
Passports, Visas & Health Documents
You are solely responsible for having a valid passport (with at least 6 months’ validity), visas, inoculations, and any other travel documentation.
If you are denied boarding or entry for lack of proper documents, WPC assumes no liability for any losses.
Local Laws
You must comply with all port/country laws, including customs, immigration, and health regulations. WPC is not liable if you violate local laws or are fined, detained, or deported.
Name Corrections
Your booking must exactly match the legal name on your travel documents. Corrections may incur a fee (e.g., $150) if Supplier manifests are already generated.
No Guarantee of Entry
WPC has no control over immigration authorities. Even with valid documents, you may be denied entry by local or national governments for reasons beyond WPC’s control.
11. CODE OF CONDUCT & ZERO TOLERANCE
Behavior & Safety
You must follow all instructions from WPC staff, ship crew, or local authorities. Disruptive, dangerous, or illegal behavior can result in removal from the Trip without refund.
Illegal Substances
WPC has a zero tolerance policy for illegal drugs. Possession or distribution onboard or ashore can lead to immediate disembarkation and referral to law enforcement.
Weapons & Hazardous Materials
Firearms, ammunition, explosives, knives (beyond small personal use), or any unsafe items are strictly prohibited.
Excessive Intoxication
Conduct that threatens safety or comfort due to intoxication can lead to removal from the Trip at your own expense, with no refund.
Unauthorized Solicitations
Commercial, political, or other solicitations are not allowed without prior WPC consent.
Smoking & Vaping
Smoking (including e-cigarettes/vaping) may be restricted to designated areas only. Smoking in staterooms or other non-smoking areas may result in cleaning fees or removal from the Trip.
Enforcement
Any violation of this Section may result in warnings, restricted privileges, or disembarkation. You remain liable for any additional costs of returning home.
12. FORCE MAJEURE
Definition
“Force Majeure” includes acts of God, war, terrorism, civil unrest, pandemics, government orders, labor disputes, severe weather, mechanical failures, or other extraordinary events beyond WPC’s control.
Effect
If Force Majeure prevents or delays the Trip, WPC’s sole obligation is to offer a refund or credit per Section 9.4. No additional damages or compensation shall be due.
13. LIABILITY LIMITATIONS & DISCLAIMER
Disclaimer of Warranties
All WPC Trips are provided on an “as is” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law.
Limitation of Liability
To the maximum extent permissible by law, WPC’s total liability for any claim—whether in contract, tort, or otherwise—shall not exceed the amount you actually paid to WPC for the Trip in question.
WPC is not liable for any indirect, special, punitive, or consequential damages (e.g., lost profits, emotional distress) under any circumstance.
Supplier Liability
Any liability for carriage by air, sea, or land or for excursions/tours is governed by the Supplier Ticket. You agree to look to that Supplier for any related claims.
Indemnification
You agree to indemnify, defend, and hold WPC harmless from any claims, damages, or expenses arising out of your breach of this Contract or violation of law.
Personal Property Disclaimers
WPC is not liable for loss, theft, or damage to your personal property, whether in staterooms, public areas, baggage storage, or any location. Use of a stateroom or resort safe is at your own risk.
14. ITINERARY & PORT CHANGES
Itinerary Alterations
All schedules, departure points, ports of call, and return times are subject to change without notice. This may include skipping or substituting ports for weather, safety, or technical reasons.
No Guarantee of Shore Access
Tendering or docking at certain ports may be affected by tides, weather, or port authority restrictions. WPC and Suppliers are not responsible for any inability to go ashore.
No Additional Compensation
Any changes in itinerary, vessel, or schedule do not entitle you to a refund or compensation beyond what is stated in this Contract (e.g., partial credit only if we cancel the entire Trip).
15. SHORE EXCURSIONS & THIRD-PARTY ACTIVITIES
Independent Operators
Shore excursions or day tours (“Excursions”) are operated by third parties. WPC is not responsible for their operations, equipment, or safety standards.
Voluntary Participation
Participation in Excursions is entirely voluntary and at your own risk. You may be subject to additional waivers or disclaimers required by the operators.
Inherent Risks
Certain Excursions (e.g., water sports, adventure tours) carry an increased risk of injury or property damage. You assume all such risks and agree WPC is not liable for operator negligence.
No Refund for Non-Participation
If you choose not to join an Excursion or arrive late, no refund or credit is due.
16. TRAVEL INSURANCE
Strong Recommendation
Due to the non-refundable nature of payments and potential medical or travel disruptions, WPC strongly advises purchasing comprehensive travel insurance.
Types of Coverage
Policies may include trip cancellation/interruption, medical & evacuation, baggage, and “cancel for any reason” (CFAR) coverage. Read policy terms carefully.
Claims
WPC is not an insurer and has no influence over policy coverage or claim decisions. If a covered event arises, you must file claims directly with your insurer.
17. DISPUTE RESOLUTION, GOVERNING LAW & ARBITRATION
Mandatory Arbitration
Any dispute, claim, or controversy arising out of or relating to this Contract shall be exclusively resolved by binding arbitration in Florida, administered by the American Arbitration Association (AAA) under its Commercial Rules.
Class Action Waiver: All claims must be brought individually, not as part of a class or representative action.
Governing Law; Venue
This Contract is governed by Florida law, without regard to conflict-of-law principles. If arbitration is deemed unenforceable, the exclusive venue is the courts in Miami-Dade County, Florida.
Time Limits
You must provide WPC with written notice of any claim within 6 months of the incident. Arbitration must be initiated within 1 year of that incident. Failure to comply bars the claim entirely.
Attorneys’ Fees
The prevailing party in any arbitration or legal proceeding is entitled to reasonable attorneys’ fees, costs, and expenses.
18. DATA PRIVACY & CONSENT
Privacy Policy
By booking or traveling with WPC, you consent to our Privacy Policy, which explains how we collect, store, and use personal data (e.g., names, contact info, payment data).
Use & Sharing
We share necessary personal data with Suppliers (hotels, airlines, cruise lines, etc.) and may disclose it to government authorities for visa, customs, or security reasons.
Consent to Contact
You agree that WPC may send transactional or marketing messages about your booking or future promotions. You can opt out of marketing at any time.
Security Measures
We use safeguards (e.g., encryption, restricted access) to protect personal data but cannot guarantee absolute security. You acknowledge inherent risks of data transmission or storage online.
19. USE OF GUEST IMAGE & LIKENESS (PHOTO & MEDIA RELEASE)
Consent to Photography/Recording
By attending any WPC Trip, you grant WPC and authorized affiliates the right to capture your image, voice, and likeness in photos, videos, or similar media for promotional or commercial use.
No Compensation
You acknowledge these media are the exclusive property of WPC, and no payment or royalties will be provided for their use.
Limited Opt-Out
If you do not want to be prominently featured, contact WPC at [email protected]. We will make reasonable efforts to respect requests but cannot guarantee complete omission from incidental crowd shots.
20. ADDITIONAL POLICIES & PROVISIONS
Onboard & Onsite Purchases
You are financially responsible for any onboard or onsite purchases (e.g., spa services, premium dining, beverages). You authorize WPC or the Supplier to charge your payment method on file for all valid charges.
Environmental & Conservation Fees
Some destinations impose environmental surcharges or taxes. If not included in your fare, such fees will appear on your invoice or onboard account.
Security & Safety Measures
WPC and Suppliers may conduct security screenings, baggage checks, or use surveillance in public areas to protect passengers and crew. By traveling, you consent to such measures.
No Additional Oral Representations
This Contract supersedes any prior discussions or statements. Oral or informal representations by WPC staff cannot override these written Terms.
English Language Governs
This Contract may be translated into other languages, but the English version is controlling in the event of a conflict.
21. SEVERABILITY & SURVIVAL
Severability
If any provision is deemed invalid or unenforceable by a court of competent jurisdiction, all other provisions remain in full force and effect.
Survival
Clauses relating to liability limitations, dispute resolution, indemnification, and disclaimers survive the termination or completion of the Trip or this Contract.
22. CONCLUSION & ACKNOWLEDGEMENT
Final Statement
By booking or participating in any World Pride Cruises LLC Trip, you expressly confirm that you have read, understood, and voluntarily accept all terms in this Contract.

You acknowledge having the opportunity to consult an attorney before booking or paying, and you accept these Terms of your own free will.
